This website (this site) is operated by The Hoyts Corporation Pty Ltd ABN 31 006 082 551 (Hoyts). This site is made available solely for access from places in Australia and to users ordinarily resident in Australia.

The following Terms and Conditions (Term) govern your use of this site and any order or purchase of a product or ticket (Product) from this site.


Introduction to Hoyts mobile ticketing

Hoyts Mobile Ticketing lets you use your mobile phone to browse movie session times and purchase tickets with your credit card or PayPal account with the same level of security as purchasing via the internet.


Use of this site

You must not use this site for any or in any manner or for any purpose which is unlawful or contrary to and of these Terms. Hoyts reserves the right to reject in its absolute discretion any order you place to purchase a Product, or to deny access to this site, for any conduct that Hoyts, in its sole discretion, believes may breach the law or any of these Terms.

Content on this site, such as graphics, logos and film clips, information, text, material, software or advertisements (Content) is protected by Australian and international copyright and trademark law. Content on the site must not be modified, copied, reproduced, republished, framed, uploaded to anyone else, posted, transmitted or distributed in any way except as expressly provided for on the site, or as expressly authorised in writing by Hoyts or its affiliates. Strictly on the condition that you keep the content intact and in the same form as presented on the network, you may download and view the content for your personal and non-commercial use.


Your personal information and privacy

You should read Hoyts’ Privacy Policy, which includes important statements about how we may retain and use personal information about you gathered in the course of your use of this site or purchase of any Product from this site.

By using this site or purchasing any Product from this site, you consent to Hoyts retaining and using your personal information in accordance with the Privacy Policy.


Buying tickets using mobile ticketing

To use Hoyts Mobile Ticketing, you must be able to access the internet from your mobile phone. Check with your mobile provider for more information on how to get connected to the internet and for pricing. Hoyts Mobile Ticketing will work on most mobile phones that can access the internet. Please check with your mobile provider about handset compatibility.

You can obtain session times and start the ticket buying process by cinema or by movie. Please follow the prompts to select your preferred cinema, movie and session. You will then be led through the check out and payment process.

You can securely pay with either you credit card or PayPal, depending on which you have enabled for Hoyts Mobile Ticketing:

Payment Option 1: Credit Card

Hoyts does not store or have access to any of your card details.

Payment option 2: PayPal

To use PayPal, you will first need a PayPal account enabled for mobile transactions. If you are not already a PayPal member, click here. If you are an existing PayPal account holder and wish to enable mobile, click here. PayPal offers account holders a secure process using their mobile phone number and 4-digit PIN that is registered with PayPal to buy movie tickets. You can also use your email address and password, although for ease of use, it is suggested that you connect your mobile phone and PIN to your PayPal account. Hoyts will not store or have access to any of your PayPal account details.


What happens if the mobile service is interrupted while completing a transaction?

Sometimes mobile technology can be interrupted during a purchase transaction (for example this may happen if you travel through a tunnel, enter an area of low reception or your phone turns off for any reason). This can mean your ticket purchase may not be successfully completed. If your ticket purchase request is not received due to such interruptions, you will not be charged. You will know if your transaction was successful because you will receive an email message confirming your purchase.


Collecting your tickets

You must collect tickets once you arrive at the cinema. You can collect your purchased tickets at the cinema by presenting:

    • the credit or debit card you used to purchase your tickets on your mobile phone
    • the booking number included in the confirmation email
    • your Hoyts Rewards card or key fob BUT only if you logged into the Hoyts Mobile Ticketing service prior to completing the transaction.
You may be asked for identification for verification (eg your driver’s license if you present the booking number).
Unfortunately, if you arrive at the cinema without any of the above or your confirmation email, and we cannot locate your booking in our ticketing system by other means, we will be unable to issue your tickets.

Abiding by Film Classification legislation

Tickets are also made available subject to the classification of the relevant film given by the Office of Film and Literature Classification.
By purchasing a ticket, you represent that you are of an age permitted to purchase a ticket pursuant to the relevant classification for the film.
You may be asked for identification to validate your age. Hoyts will not issue tickets purchased to a restricted session if in doing so, it breaches classification legislation.


Links and advertisements

This site may include links to other websites (Linked Websites). Unless otherwise stated at those websites, those websites are not controlled by Hoyts. By using those links, you acknowledge and agree: Hoyts is not responsible for the availability of, or in relation to, content located on or through a Linked Website; inclusion of a Linked Website on this site does not imply any endorsement of the Linked Website by Hoyts or its affiliates or their respective directors and employees; and you link to any Linked Website at your own risk.

To the extent that this site contains or links an advertisement by anyone other than Hoyts, including referral buttons and embedded hyperlinks, (Third Party Advertisement) any such advertisement is paid for by the relevant advertiser and does not represent a recommendation or endorsement by Hoyts or its affiliates or their respective directors or employees. Where a Third Party Advertisement contains offers of products by an advertiser, you may be permitted to accept that offer by linking to a Linked Website and executing the relevant transaction. Such product offers are not made by Hoyts, and the third party supplier is solely responsible to you for the delivery to you of any product or service you purchase at a Linked Website.


Important limitations of Hoyts’ liability

The Trade Practices Act and similar State and Territory Legislation in Australia may confer certain non-excludable rights and remedies on you in relation to access to or use of this site and provision of a Product (Consumer Rights). Hoyts does not exclude any Consumer Rights, but does exclude all other conditions and warranties implied by custom, law or statute. Subject to any Consumer Rights you may have, all Content is provided as is and without warranties of any kind, either express or implied. Without limiting any other Term or Consumer Right, Hoyts and its suppliers do not warrant that this site or any Content, or any contribution by a Member in the Forum, is fit for a particular purpose or of merchantable quality; that any Content or your access to this site will be uninterrupted or error-free; that any defects in this site or Content will be corrected; that this site or the server which stores and transmits Content to you are free of viruses or any other harmful components; or the results of your access to, this site (including any related or Linked Website) or any Content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise. Without limiting any other Term or Consumer Right, Hoyts and its affiliates or directors or officers exclude liability for any indirect, incidental, special or consequential damages, or loss of business or profits, which results from any use or access of, or any inability to use or access, this site or any Content. Subject to any Consumer Rights you may have, Hoyts' liability for breach of any implied warranty or condition is limited to any of the following, at Hoyts' option: in the case of services supplied or offered by Hoyts, in the following order, the supply of the services again or the payment of the cost of having services supplied again; and in the case of goods supplied or offered by Hoyts, in the following order, the replacement of the goods or the supply of equivalent goods, the repair of such goods, the payment of the cost of replacing the goods or acquiring equivalent goods, or the payment of the cost of having the goods repaired (in that order).


Your indemnity

Hoyts relies on your continued observance of these Terms. If Hoyts suffers any loss or damage or incurs any costs in connection with any breach by you of these Terms or any other legal obligation, then you agree to indemnify Hoyts for those losses, damages and costs.


General

These Terms will be governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the agreement which will continue in full force and effect. We may from time to time change the terms that govern your use of this site. Your use of this site following any such change constitutes your agreement to follow and be bound by the terms as changed. We may change, move or delete portions of, or may add to, this site from time to time
